      2. BIR TAX ADVISORY ON THE FILING OF 2023 ANNUAL ITR DUE ON OR BEFORE APRIL 15, 2024

        In a Tax Advisory signed on March 25, 2024, the BIR has advised the taxpayers on the following in line with the 2023 Annual Income              Tax Returns (AITR) filing due for submission on or before April 15, 2024:

 

  1. Taxpayers needing assistance may visit the BIR’s Tax Assistance Center (TAC) at the BIR National Training Center (NTC)-Auditorium from March 23 to April 15, 2024, except Sundays and Holidays from 8:00 AM to 5:00 p.m. Desktop computers are provided for the electronic filing either through eBIRForms or eFPS, and online tax payments through ePayment channels. TAC personnel shall accept returns of taxpayers regardless of jurisdiction.
  2.  All taxpayers shall electronically file their AITR. No manual filing, except:

      2.1 Senior Citizen (SC) or Persons with Disabilities (PWDs) filing their own tax returns.

      2.2 Employees deriving purely compensation income from two or more employers, concurrently or successively at any time during the            taxable year, or from a single employer, although the income of which has been correctly subjected to withholding tax, but whose                    spouse is not entitled to substituted filing.

     2.3 Employees qualified for substituted filing but opted to file an ITR and are filing for purposes of promotion, loans, scholarships, foreign       travel requirements, etc.

     3.No need to submit printed copy of electronically filed returns for stamping

    3. SEC UPDATES FINES & PENALTIES ON THE LATE & NON-SUBMISSION OF AFS, GIS & OTHER REPORTORIAL                              REQUIREMENTS

    SEC Memorandum Circular (MC) No. 6, Series of 2024, dated March 27, 2024, circularizes the updated fines and penalties on the late          and    non-submission of Audited Financial Statements (AFS), General Information Sheet (GIS), and non-compliance with SEC MC 28,          which          requires corporations, partnerships, associations, and individuals to create an email address and designate a mobile phone        number for          transactions with the SEC.

  4. CTA CASE ON BIR COLLECTION ENFORCEMENT PENDING APPEAL BEFORE THE CIR

   [WHEN THERE IS A PENDING PROTEST, THE ASSESSMENT IS NON-DEMANDABLE & THE BIR CANNOT COLLECT A NON-            DEMANDABLE ASSESSMENT] [COLLECTION MEASURES EMANATING FROM NON-DEMANDABLE ASSESSMENT SHALL BE         VOID & OF NO FORCE & EFFECT] [TAX AUTHORITIES ARE BOUND TO CONSIDER THE PROTEST FIRST, BEFORE PROCEEDING   AGAINST THE TAXPAYER FOR COLLECTION] 

 Petitioner C.U.T. Commercial Corporation filed a Petition for Review asking the Court to declare as void the Preliminary Collection Letter       (PCL) issued by the Respondent Bureau of Internal Revenue (BIR), relative to the alleged deficiency taxes for the taxable year 2014. The   Petitioner argued that the PCL was premature, taking into account that its Motion for Reconsideration (MR) of the Final Decision on   Disputed Assessment (FDDA) was still pending before the Commissioner of Internal Revenue (CIR). On the other hand, the Respondent   countered that the issuance of the PCL was proper, taken that the FDDA had already become final and executory. In ruling, the Court cited   the Supreme Court case of Light Rail Transit Authority vs. Bureau of Internal Revenue (LRTA Case) wherein it explained that to ground the   collection measures on the premise of the existence of “delinquent taxes” is incorrect. A PCL, as well as a Final Notice Before Seizure,   Warrant of Distraint and/or Levy, or other means of summary administrative collection, remain tentative for as long as there is a pending   administrative appeal before the Office of the CIR. In the case at bar, the assessment against the Petitioner remained to be non-   demandable, on account of circumstances similar to those in the LRTA Case. In other words, the assessment against the Petitioner   remained tentative given the pending MR before the CIR. Thus, the Petition was GRANTED, and the subject PCL was ANNULLED for   being void and ineffectual. [C.U.T. COMMERCIAL CORPORATION VS.
